Pocket Capy: Virtual Pet - Terms of Service

Effective date: October 30, 2026

These Terms of Service ("Terms") govern your use of Pocket Capy: Virtual Pet ("the game", package com.eskimo.pocketcapy), published by Eskimo Technologies Group ("we", "us"). By installing or using the game you agree to these Terms. If you do not agree, do not use the game.

1. Who can use the game

The game is for all ages. If you are under 13, or under the age of digital consent where you live, you must play with the permission of a parent or guardian. If you are under 18 (or under the age of majority where you live), a parent or guardian must approve any purchase. A parent or guardian who lets a child use the game agrees to these Terms for the child. Section 11 of our Privacy Policy explains how the game handles children's information.

2. License

We give you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the game on your Android device for personal, non-commercial use. We keep all rights in the game, including its code, characters, art, sounds, names and logos. You may not:

• copy, modify, sell, rent or distribute the game;
• reverse engineer, decompile or extract the source code, except where the law allows it;
• remove any notices or branding.

3. Acceptable use

You agree not to:

• cheat, hack, or tamper with the game, its data or its ads;
• use bots, emulators or tools to create fake ad views, clicks or purchases;
• try to get paid features without paying, or abuse refunds;
• use the game to break the law or harm others;
• interfere with the services the game relies on.

We may limit or stop your access to the game if you break these rules.

4. Coins, items and progress

Coins are earned by playing the game, for example by caring for your pet, finishing mini-games, claiming the daily gift and watching reward videos you choose to watch. Coins cannot be bought with real money. You use coins to buy food, hats and accessories, and room colors in the shop.

Coins, items, your pet and your progress have no cash value. They cannot be sold, traded or transferred, and cannot be exchanged for money. There is no way to send coins or items to other players. Progress is saved on your device only. If you uninstall the game or clear its data, it may be lost, and we may not be able to restore it. A purchase can be restored through Google Play using the same Google account.

5. In-app purchase

• The game offers one one-time purchase: Remove Ads. It is non-consumable and is bought once. There are no subscriptions and no coin packs.
• Purchases are made and charged through Google Play. Google processes the payment. We never see your card details.
• Prices are shown in the store in your local currency and may include taxes.
• Parents can use Google Play parental controls and purchase authentication to approve or block purchases.
• Refunds are handled by Google under the Google Play refund policy. Contact Google Play support for refund requests. You can also email us and we will help where we can, but Google decides on refunds.
• If a purchase is refunded or reversed, we may turn ads back on.

6. Ads

The game is free and shows ads from third parties (Google AdMob). We do not control the ad content. Buying "Remove Ads" removes app open ads, ads between mini-games and banner ads. Reward videos stay available, because you choose to watch them to get extra coins. For users under 13, ads are treated as child-directed, are not personalized and are limited to content rated G. How ads use your data is explained in our Privacy Policy.

7. Pet care reminders

The game can remind you to care for your pet. Reminders are optional. They are created on your device, and you can turn them off in the game's Settings or in your Android notification settings. Your pet does not get sick, run away or die if you do not play.

8. Privacy

Our Privacy Policy explains how data is handled. By using the game you confirm you have read it. Parents and guardians should read section 11 of the Privacy Policy.

9. Third-party services

The game uses Google services, including Google Play, AdMob and Firebase. Your use of these services is also covered by their own terms. We are not responsible for them.

10. Updates and availability

We may update, change, suspend or stop the game or any feature at any time. Some updates may be required to keep playing. We do not promise that the game will always be available or free of errors.

11. Disclaimers

The game is provided "as is" and "as available". To the fullest extent the law allows, we give no warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Some laws do not allow these limits, so they may not apply to you.

The game is for entertainment. Take regular breaks when you play.

12. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or game progress, arising from your use of the game. Our total liability to you for any claim is limited to the amount you paid us for the game in the 12 months before the claim, or USD 10 if you paid nothing. Nothing in these Terms limits liability that cannot be limited by law, or any consumer rights you have under mandatory local law.

13. Termination

You can stop using the game at any time by uninstalling it. We may end your license if you break these Terms. Sections that by nature should continue (coins and progress, disclaimers, liability, governing law) continue after termination.

14. Governing law

These Terms are governed by the laws of Vietnam. Disputes will be brought to the competent courts of Vietnam, except where mandatory consumer law in your country gives you the right to bring a claim in your local courts.

15. Changes to these Terms

We may update these Terms. We will change the effective date above. If you keep using the game after an update, you accept the new Terms. If you do not agree, stop using the game.
